These Terms & Conditions (“Terms”) govern your use of Swapy, an open-source JavaScript library provided by Taha Shashtari (“I,” “me,” or “my”). By accessing, downloading, or using Swapy, you agree to these Terms.

Licenses

Swapy is offered under a dual-license model:

• GPLv3 License: Free for open-source projects.
• Paid Commercial License: Required for private source code.

Commercial License Options

1. Single Developer: $20
2. Team of Up to 8 Developers: $100
3. Unlimited Developers (Organization-wide): $200

Licenses are a one-time purchase. Upon purchase, you will receive a PDF containing your license details. Use of the commercial license is tied to the purchaser's email address as recorded in the Orders section of the payment processor.

Permitted Uses

GPLv3 License: Allows for open-source distribution and modification, subject to the terms of the GPLv3.

Commercial License: Grants the right to use Swapy in private, commercial projects without the requirements of the GPLv3 license.

Restrictions

You may not resell, redistribute, or sublicense the Software without explicit written permission.

You may not use the Software in violation of applicable laws or regulations.

Refund Policy

Consumer Right to Cancel

If you are a consumer, you may request a refund within 14 days of your purchase. However, refunds are only granted under the following conditions:

• Your license record will be removed from the orders section, effectively revoking your right to use the product.
• Any associated support rights described in the license will also be terminated.

To cancel, you must inform me via email at [email protected].

Effect of Cancellation

Upon valid cancellation, I will refund your payment within 14 days using the original payment method.

Exceptions

Refunds are at my sole discretion and may be refused in cases of fraud, abuse, or misuse.

Payment Terms

Payments for commercial licenses must be made through my authorized payment processor. It is your responsibility to provide accurate payment details. Refunds for payments made via wire transfer or indirect sales tax refunds may be subject to specific conditions outlined in the Refund Policy.

Ownership & Intellectual Property

The Software and all associated intellectual property rights remain the sole property of Taha Shashtari. By purchasing a commercial license, you are granted limited rights to use the Software as described under the license terms.

Disclaimer of Warranties

Swapy is provided “as-is,” without warranty of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the extent permitted by law, Taha Shashtari is not liable for any indirect, incidental, or consequential damages arising from the use of Swapy. Taha Shashtari’s total liability will not exceed the amount paid for the license.

Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflicts of law principles. You agree to submit to the jurisdiction of the state or federal courts in New York County, New York, for any disputes arising under these Terms.

Amendments

I reserve the right to modify these Terms at any time. Changes will be effective upon publication on my website.
